Terms and conditions
Effective date: 19 October 2026
These terms govern the use of Ocasio24 (ocasio24.com), a classifieds platform where individuals and companies publish offers and get in touch with each other. The site is run by the company described on the Legal notice page ("we"). By creating an account you accept these terms; how we process your data is explained in the Privacy policy.
1. The service
We offer, currently free of charge, publishing and searching listings, messages between users, company pages, favourites and search alerts. We do not sell or buy the goods in the listings and we are not a party to the agreements between users. If we introduce paid services, their conditions and prices will be shown before you order them.
2. The account
- You can create an account only if you are 18 or over.
- Your account data must be true and up to date. You use a single personal account; multiple accounts created to get around the site's rules or limits are not allowed.
- You keep your password secret and tell us if you suspect someone else is using your account.
- If you publish listings as a professional activity, use a company account. Whoever creates a company account confirms they are entitled to represent the company. Company details may be checked in public registers, and listings of companies not yet verified may be checked before they are published.
3. Listings
- You are responsible for the content of your listings: they must be real, accurate, in the right category, and about goods or services you are entitled to offer.
- Contact details (phone, e-mail, website, QR codes) go only in the fields meant for them, not in the title, description or photos; we may remove them from the text automatically.
- Photos must show the item offered and be yours or used with permission.
- The listing's town is public. The exact address and the point on the map appear only if you choose "Show the exact location".
4. What is not allowed
You may not publish or send through the site:
- goods or services prohibited by law (for example drugs, weapons without a licence, stolen or counterfeit goods, false documents, protected animals, sexual services);
- misleading content, fake listings, pyramid schemes or offers of unrealistic earnings;
- defamatory, threatening or discriminatory content, content inciting hatred or violence, or sexually explicit content;
- content that infringes the rights of others (copyright, trade marks, privacy, other people's personal data);
- advertising without a concrete offer, spam, duplicate listings or mass messages;
- malicious software or attempts to access the site, other people's accounts or their data without authorisation, including automated data collection (scraping).
5. Licence for your content
The content you publish remains yours. You give us a non-exclusive, free licence, valid while the content is on the site (plus the technical time needed to delete it from backups), to host it, display it, adapt it technically (for example resize photos) and make it findable (in the site's search, in search engines and in listing pages).
The name Ocasio24, the logo, the design, our own texts and the database of listings belong to us or to those who licensed them to us. You may not copy, reproduce or extract them, wholly or in substantial parts, without our written consent; the open-source software the site uses stays under its own licences.
6. Dealings between users
Agreements are made directly between buyer and seller, who are responsible for them. We do not guarantee the quality, legality or existence of the items in listings, nor that users keep their commitments. We recommend that you see the item before paying, do not send money in advance to strangers and report any suspicious listing to us. Your consumer rights against a professional seller are not affected.
Reviews. Anyone with an account can write a review of a company, once per company and never of their own company; the author can edit or delete it at any time. The "Verified transaction" label only shows that the author contacted the seller through the site; we do not check whether they bought anything. We do not pay for or ask for reviews and we do not rank them by how favourable they are. Anyone can report a review with the "Report review" button; we delete it if it breaks these terms or the law (for example if it is fake, insulting or contains personal data).
7. Reports, moderation and appeals
- Anyone can report a listing with the "Report listing" button, a review with the "Report review" button, and any content (including a profile or a message) through the contact form, explaining why they consider it illegal or contrary to these terms. We review reports diligently and without undue delay.
- We may check listings before or after publication and may reject, correct, hide or delete content, limit account features, hide or suspend the account, depending on how serious the breach is. When we take such a measure, we tell you the reason and its basis.
- You can appeal the decision by replying to the message you received, by asking for a review of a hidden account in your account, or by writing to us. Appeals are reviewed by a person. You also have the right to turn to a certified out-of-court dispute settlement body or to a court. You can also lodge a complaint about compliance with the Digital Services Act with the Digital Services Coordinator.
- In serious cases (fraud, illegal content, risk to other users) we may act without prior warning.
8. E-mails
We send you e-mails the service needs: address confirmation, password reset, new messages, changes to the status of listings or the account. Search alerts and listing reminders are sent only if you turn them on, and you can stop them at any time. We do not send you advertising without your consent.
9. Liability
We do our best to keep the site running without interruptions or errors, but we cannot guarantee it. We are not liable for content published by users or for transactions between them, except where the law provides otherwise (for example if, after learning of illegal content, we did not act). Nothing in these terms limits our liability for intentional acts or gross negligence, or the rights the law gives you as a consumer.
10. Closing the account
You can close your account at any time in Profile. A closed account can be reopened by logging in for 30 days, after which its data is anonymised as described in the Privacy policy. We may close an account that seriously or repeatedly breaches these terms, stating the reasons for the decision. An account unused for 3 years is anonymised; its listings that were public stay on the site as an archive, without the seller's details, and the licence in section 5 continues for them until you ask us to delete them.
11. Changes to the terms
We may change these terms, for example when the law or the service changes. We let you know in your account at least 15 days before important changes apply; if you do not agree, you can close your account. The date of the version in force is shown above.
12. Governing law and disputes
These terms are governed by Spanish law. If you are a consumer, you keep the protection given by the law of the country where you live and can bring proceedings before the courts where you live, and we can only sue you there. If you use the site as a business or professional (for example with a company account or through the API), any dispute with us falls under the exclusive jurisdiction of the courts of Alicante (Spain); this rule applies to disputes started from 5 November 2026. Before any dispute, please write to us so that we can try to reach an amicable solution.
13. Contact
For questions about these terms, reports or communications from authorities, write to contact@ocasio24.com or use the contact form. We answer in the language of this page or in English.
